This Privacy Policy describes how and when Functional Gifts & Homeware collect, use, and share information when you purchase an item from, contact, or otherwise use the services of

This Privacy Policy does not apply to the practices of third parties that Functional Gifts & Homeware do not own or control, including PayPal or any third party services you access to make payment for your order.  If you pay with PayPal your data will be protected by PayPal’s privacy policy.


Information Collected

To fulfil your order, you must provide certain information such as your name, email address, telephone number, postal address, billing address, and payment information.  You may also choose to provide additional personal information if you make contact directly.


Why Your Information Is Needed and How It Is Used

The legal bases relied upon to collect, use, and share your information, include:

  • as needed to provide a service to you, such as when the information is used to fulfil your order, to settle disputes, or to provide customer support;
  • when you have provided your affirmative consent, which you may revoke at any time, such as by signing up for a mailing list;
  • if necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law; and
  • as necessary for the purpose of legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as providing and improving services. The information is used to provide the services you requested and in the legitimate interest of improving services


Information Sharing and Disclosure

Your personal information is shared for very limited reasons and in limited circumstances, as follows:

  • Service providers. we engage certain trusted third parties to perform functions and provide services, such as delivery companies. Your personal information will be shared with these third parties, but only to the extent necessary to perform these services.
  • Compliance with laws. Your information may be collected, used, retained, and shared if we have a good belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of customers, or others.


Data Retention

Your personal information is retained only for as long as necessary to provide you a service and as described in the Privacy Policy. However, it may also be required to retain this information to comply with legal and regulatory obligations, to resolve disputes, and to enforce agreements. Your data is generally kept for 6 years for the main part to comply with tax responsibilities.


Transfers of Personal Information Outside the EU

Currently we do not store or process your information through third-party hosting services outside of the EU.  Should the need arise to transfer your personal information to a jurisdiction with different data protection and government surveillance laws this will be completed via a Privacy Shield certified service provider.


Your Rights

If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. These rights are:

  • Access. You may have the right to access and receive a copy of the personal information held about you by making contact using the contact information below.
  • Change, restrict, delete. You may also have rights to change, restrict use of, or delete your personal information. Absent exceptional circumstances (like where it is required to store data for legal reasons) generally your personal information will be deleted upon request.
  • Object. You can object to (i) the processing of some of your information based on legitimate interests and (ii) receiving marketing messages after providing your express consent to receive them. In such cases, your personal information will be deleted unless there are compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.
  • Complain. If you reside in the EU and wish to raise a concern about the use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.



Cookies are used very little on the website and only to aid the shopping experience.  There are two session cookies for the purposes of remembering shopping basket contents and for recognising returning customers.  If cookies were not used the website could not remember which items were placed into the basket and would make checkout impossible.  All session cookies expire within a certain timeframe.
